questions & answers...

Q: What is Superior Court?
A: The Superior Court is Georgia’s general jurisdiction trial court. It has exclusive, constitutional authority over felony cases, divorce, equity and cases regarding title to land.

Q: What are the qualifications to be a Superior Court Judge?
A: To qualify as a Superior Court Judge, a candidate must be at least 30 years old, a citizen of Georgia for at least three years, and have practiced law for at least seven years.

Q: What type of cases do you hear as Superior Court Judges?
A:
Superior Court handles a wide range of cases including drug cases, adoptions and even murder cases, to name a few. The responsibilities of Superior Court judges include issuance of sentencing ranging from one year to the death penalty.

The exclusive jurisdiction of this court also covers such matters as declaratory judgments, habeas corpus, mandamus, quo warranto and prohibition. The Superior Court corrects errors made by lower courts by issuing writs of certiorari; for some lower courts, the right to direct review by the Superior Court applies.

Q:
How many cases do Judges handle?
A: On average, a Superior Court Judge manages about 2500 cases per year. That number can be higher, of course.

Q:
Are you the Democratic or Republican nominee?
A: Judges are chosen through non-partisan elections.

Q:
How long is the term for Superior Court Judges?
A: We serve four year terms.

Q: To whom do Superior Court Judges report?
A: We are accountable only to the citizens of Fulton County.

Q: Do Judges listen to arguments and then decide who should win?
A: Judges listen to the presentation of arguments and apply the law.

Q: Should public opinion play a role in a Judge’s decision?
A: Judges are bound by the law and should not allow public opinion to interfere with their decisions. When the public disagrees with a law, they should petition their legislators.

Q: Why should people who do not have business before the Court be concerned with elections of Judges?
A: First of all, no one knows when they may need to appear before or engage the courts. The larger issue is that people should be concerned because the courts have an interest in maintaining justice in society. The Judiciary is the third branch of government; it is the arm of government that is charged with ensuring the individual rights of citizens and businesses are not trampled.
